Supreme Court dismisses PDP’s suit against Tinubu, Shettima’s eligibility

The Supreme Court in Abuja has nullified the suit filed by the opposition party, the PDP, contesting the eligibility of Bola Ahmed Tinubu and Kashim Shettima as presidential and vice-presidential candidates respectively of the All Progressives Congress (APC).

The suit was instituted by the party to seek the disqualification of the duo’s ticket of the APC for the 25 February presidential election.

A five-member panel of the apex court held on Friday that the PDP lacked the locus standi to institute the suit.

The party (PDP) premised its prayers on the grounds of alleged double nomination of Mr Shettima as APC’s vice-presidential candidate and the party’s senatorial candidate for Borno Central in the same election.

The PDP also claimed that Shettima’s nomination as Tinubu’s running mate breached the provisions of Sections 29(1), 33, 35, and 84(1)(2) of the Electoral Act, 2022.

It also argued that Shettima’s nomination to contest the position of vice-president and Borno central senatorial seat simultaneously contravened the law.

With the judgement, the coast is now clear for the inauguration of Tinubu and Shetima as president and vice -president of Nigeria on Monday, May 29.
